TERMS AND CONDITIONS
Photographers and videographers are refered to as the photographer.
0.1. Wedding gifts are subject to availability and may vary, gifts have no monitary value as per booking and are a genuine gift. Gifts are presented as a wedding gift within 28 days of your wedding day. Items are first come first serve basis with rrp upto £495.
1. It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. Special Requests/Coverage
The client understands and accepts that the photographic coverage will be as the photographerʼs professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the clientʼs wishes. Any special requests not notified on this booking form must be made by the client to the photographer/s in writing.
2.1 Prizes and Donated Services
All prizes and donated services are strictly non transferable and only available to the original recepient. All prizes and donated services have NO cash value and cannot be used as part payment or full payment of another service. Prizes and donated services may be withdrawn at any time if unreasonable demands are deemed to be made. All prizes and donated serviecs are given as an individual service and are in no way payment or in return for any advertising or any promotional service. All prizes and donated services stated values & names are for a similar commercial package and for illustration purposes only. All prizes and donated servies contents are stated when donated and are for the service agreed and cannot be changed withour prior agreement or aditional costs being incurred. All aditional costs incurred are deemed as a separate booking and are covered by our standard terms and conditions.
4. The Photographer / Videographer
On occasions and without notice it may be necessary for the photographer originally specified to be substituted by another photographer, (e.g. due to ill health).
5. Images
All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film/digital the exact colour as seen by the human eye.
6. Retouching
The photographer will perform a standard amount of retouching to take the photographs to a quality of which he is proud. Further retouching, digital manipulation and artist
finishing is available to the client as an optional extra.
7. Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.
8. Negatives/Digital Files
Negatives/digital files remain the property of the photographer/s.
9. License
The photographer/s shall be granted complete artistic license including in relation to the poses photographed and the locations used. The photographer/sʼ judgement regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
10. Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation owing to any cause beyond their control.
11. Previews
Although the photographer will do his best to produce more proofs/preview images than as discussed with the client, there is no guarantee that any particular number of proofs/preview images will be produced.
12. Display
The client hereby allows the photographer/s to display any images included in this contract in their studios, portfolios, literature, wedding, exhibitions and advertising. No use of the images will 3 be made by the photographer/s for other commercial reason except with the written permission of the client.
13. Cancellation
The client may cancel this contract at any time by giving written notice to the photographer/s but in doing so shall forfeit any monies paid. Payments made at the time of booking are classed as the deposit. Should cancellation be received by the photographer/s less than 180 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 100% of the contract value otherwisw 50% of the total amount is to be paid. The said sum shall be payable as compensation as an estimate of the loss the photographer/s & videographers would suffer.
13.1 Postponement
If a client wished to postpone their wedding by giving written notice to the videographers/photographer/s a £200 date amendment fee would be payable. 50% of the final balance would become due with the remaining 50% payable 28 days before the new wedding date.
13.2 Our free date change service is for qualifying bookings only and is strictly subject to date availability. If we are not available on your re-booking date bookings are cancelled as per terms and conditions. Dates will be allocated at our discression.
13.3 Government restrictions. If our services cannot be provided due to government restrictions our services will be offered at a later date subject to date availbability.
14. Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
15. Complaints
Any complaints should be raised by the client with the photographer/s, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 7 days of receipt of the images.
16. If for any reason our staff encounter any unreasonable behaviour or abuse in any way while carrying out their duties they reserve the right to cancel the services, any monies paid will be forfeited.
17. The balance stated on your invoice is due 28 days before the event, if the balance remains unpaid after 2 reminders or is not paid within 21 days of the event we assume that you as the client wish to cancel the booking unless prior late payment agreement in approved and confirmed by us in writing.
18, For Last minute bookings payment is due immediately and is non refundable if cancelled.
Having read the booking form and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed in writing. These terms are also set out during online form confirmation and signing.
